INFORMATION NOTICE ON THE PROTECTION OF PERSONAL DATA

 As the (“Company”), we attach importance to protecting the personal data of our valued customers and would like to inform you under Law No. 6698 on the Protection of Personal Data (“KVKK”).

1. What Is Personal Data?

Under the KVKK, personal data means any information relating to an identified or identifiable natural person (“Personal Data”). Special categories of personal data include data relating to race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, appearance and clothing, association, foundation or trade union membership, health, sexual life, criminal convictions and security measures, as well as biometric and genetic data (“Special Categories of Personal Data”). 2. By Which Methods and on Which Legal Grounds Do We Collect Your Personal Data?

In all Personal Data processing activities we conduct, we act in accordance with the obligations and principles set out primarily in the KVKK and other relevant legislation and take the necessary security measures to ensure that your Personal Data is processed securely. Pursuant to the KVKK, we collect your Personal Data automatically or non-automatically, verbally, in writing, audibly or electronically through the channels listed below and any other channels that may be added in the future, and process it depending on the purpose under Articles 5.1, 5.2, 6.2 and 6.3 of the KVKK:

· through our call centers (“Call Center”) managed by the Company or third parties from which the Company receives services,
· through third parties such as group companies to which the Company provides or from which it receives services, business partners, manufacturers, and companies from which products or services are supplied, by automatic or non-automatic means, verbally, in writing or electronically.

4. Which Personal Data Do We Process?

Examples of the Personal Data we process include the following:

5. For Which Purposes Do We Process Your Personal Data?

As a rule, we process your Personal Data based on your explicit consent. However, in exceptional cases permitted under the KVKK, your Personal Data may also be processed without your explicit consent under Articles 5.2 and 6.3 of the KVKK.
In this context:

a) Under Articles 5.2 and 6.3 of the KVKK, we process your Personal Data without seeking your explicit consent: (i) to fulfill our legal obligations, including obligations under tax legislation, consumer protection legislation, occupational health and safety legislation, the Code of Obligations, the Commercial Code, telecommunications legislation, banking legislation and other applicable legislation; (ii) where processing is necessary to protect the life or physical integrity of you or another person when you are unable to express consent due to actual impossibility, or where the consent of the relevant person is not legally valid; (iii) where processing is necessary for the establishment or performance of a contract, the fulfillment of our legal obligations, or the establishment, exercise or protection of a right, including membership agreements, providing products and services ordered or purchased through the Websites, contacting you where necessary, conducting purchase and sale transactions at Company stores, using POS systems, handling returns, providing transportation services, establishing distance sales contracts within the scope of electronic commerce, selling, supplying and delivering products or services, receiving and responding to questions and complaints, providing after-sales services, and using related information in a possible dispute; and (iv) to protect our legitimate interests, provided that your fundamental rights and freedoms are not harmed, including reducing costs, using resources efficiently, and monitoring call-center service quality. (vi) To send gifts, promotional materials, magazines and other periodical publications.
(vii) To conduct corporate communications, organize events and invitations within this scope, and provide information about them.
(viii) In addition, if your explicit consent is available, your Special Categories of Personal Data may be processed for the purposes specified in Article 5.2 of the KVKK and for the purposes listed in items (i) through (vii) above.
In this context, you may support us in providing you with better service by giving your consent in the documents and fields where explicit consent is requested for each type of processing that requires your consent under this Information Notice. However, this Information Notice has been prepared solely to fulfill our obligation to inform you as the Data Controller under the KVKK. Your explicit consent for such processing activities will be obtained separately, and if you do not provide explicit consent through the relevant channels, those processing activities will not be carried out.

6. How Long Do We Process Your Personal Data?

Your Personal Data will be processed in accordance with the periods required under the KVKK, legislation on the protection of Personal Data and other applicable legislation, and in any event for as long as the legitimate purposes stated above continue to exist.

7. Transfer of Your Personal Data to Third Parties and/or Abroad

The Company may transfer your Personal Data collected through the channels and methods stated in this Information Notice to third parties or abroad within the scope of the KVKK and other applicable legislation and for the purposes stated in this Information Notice. Your Personal Data may be transferred as follows:

b) Subject to obtaining your explicit consent under Articles 5.1 and 6.2 of the KVKK, your Personal Data may be transferred within Türkiye and abroad, particularly to the European Union countries, the United States, the United Kingdom, OECD countries, Dubai, India, China and Russia, to third parties from which we receive support in areas such as storage, archiving, information technology support (server, hosting, software, cloud computing), security and call-center services; Group Companies that manufacture and distribute the products of the Company and/or yesilbatimobilya.com.tr; business partners; suppliers; banks; financial institutions; consultancy firms providing legal, tax and similar support; CRM companies; market research companies; and third parties providing support in advertising, marketing and sales activities such as e-mailing and SMS delivery.
In addition, based on your explicit consent, if all or part of the Company or its assets are sold, including but not limited to its brand, domain name and other commercial enterprise elements, your Personal Data may be transferred to the acquiring natural or legal persons and, to the extent required by the transfer, to third parties in Türkiye or abroad, including their shareholders, business partners, intermediaries and advisers. During the transaction, your Personal Data may be processed by these third parties only to the extent necessary to conduct the required assessment, and following the transfer, the acquiring party may continue to process your Personal Data as the new data controller together with the transferred assets and related values.

8. Access to Your Personal Data and Your Rights Under the KVKK

Under Article 11 of the KVKK, you have the right to apply to the Company and:

· request information if your Personal Data has been processed,
· learn the purpose of processing your Personal Data and whether it is used in accordance with that purpose,
· know the third parties in Türkiye or abroad to whom your Personal Data has been transferred,
· request correction of your Personal Data if it has been processed incompletely or inaccurately,
· request deletion or destruction of your Personal Data when the reasons requiring its processing cease to exist, subject to an assessment based on purpose, duration and lawfulness principles,
· request that correction, deletion or destruction operations be notified to third parties to whom your Personal Data has been transferred,
· object to a result arising against you where your processed Personal Data is analyzed exclusively through automated systems,
· request compensation for damages if your Personal Data has been processed unlawfully and you have suffered damage as a result.
